Employers wishing to contest OSHA findings must do so in writing within 15 working days after receipt of the citation. The Notice of Intent to Contest must state what is being contested including the citation, the penalty, and the abatement date. Before filing a Notice of Intent to Contest, OSHA recommends you meet informally with the OSHA area director to discuss the citations and proposed penalty, in order to get a better explanation of the violations and to make sure you understand the specific standards that apply. This is an especially good idea if you are just contesting the date of abatement, since the OSHA area director has the authority to extend this date without your having to file a Notice of Intent to Contest.
